Jimmy Choo class action lawsuit settlement has been agreed lately. The luxury shoemaker will have to pay, wait… $2.5 million for violating the Fair and Accurate Credit Transactions Act (FACTA).
The thing is that the company printed its customers’ sensitive data on credit card receipts. This could pose risks of identity theft. Let’s note that Plaintiff Kerri C. Wood filed the class action lawsuit in October 2015. Wood filed the lawsuit in Florida alleging that the company printed more than five numbers of customers’ credit or debit card numbers along with expiration dates on receipts.
In her lawsuit, Kerri Wood tells that she shopped in Jimmy Choo store in Palm Beach Gardens, Florida using her MasterCard credit card. She then claims that they presented her with a printed credit card receipt which was bearing the expiration date of her card.
Additionally, she claimed that the credit card receipt contained other sensitive data too. Such as her home address, phone number, and the name of the person who conducted the transaction. However, FACTA allows printing either the last digits of consumer credit or debit cards or the expiration dates on the receipts.
Thus, Wood claimed that Jimmy Choo deliberately chose not to comply with this rule. Note that the company had to follow the rule since December 2006.
At the time when Wood filed the Jimmy Choo class action lawsuit, lawyers were arguing about the fees. They suggested that the company should pay something between $100 and $1000 for each FACTA violation. Now that Jimmy Choo class action settlement is here, the company will set up a $2.5 million fund to compensate all opt-in class members. These are the people who received credit or debit card receipts from a Jimmy Choo store. Note that the receipts should contain a card expiration date between October 27, 2013, and November 2, 2013.
The estimated number of Jimmy Choo customers is more than 135,000. Depending on the precise number of the class members, each of them will get between $75 and $175 as compensation.
