Vantage Travel Facing a Class Action lawsuit

Vantage Travel Service Inc., d/b/a Vantage Deluxe World Travel and Vantage Adventures are facing a class action lawsuit. The plaintiffs claim they paid for a 15-day luxury cruise. However, Vantage Travel provided plaintiffs with only a cruise that lasted five days and eight-day bus trip.
In fact, the plaintiffs who filed the lawsuit against the tour companies are Ronald Herbert and Aime Denault. The complaint notes Herbert and Denault signed a contract with Vantage Travel. The goal was to purchase a “5 Star Luxury” river cruise, which included the following destinations: Hungary, Austria, as well as Germany. It was scheduled that this cruise should start in July 2016. According to the lawsuit, the tour company advertised the cruise as “Majestic Rivers of Europe.”

The plaintiffs mention the agreement signed with Vantage Travel concealed certain essential contract terms. This includes the information concerning the real owners and operators of the MS River Voyager. According to the company’s advertisement, it is a “Deluxe state-of-the-art ship”, which forms a part of ‘’our fleet.’’ Additionally, the tour company concealed the fact that there was neither an emergency plan nor qualified agents on the ship.

Herbert and Denault stated in their complaint that it was the company’s responsibility to provide a contingency plan aimed at addressing emergency situations on the cruise ship. However, Vantage Travel failed to provide this service.

Besides not providing the promised 15-day cruise, the company failed to give the plaintiffs any refunds, according the lawsuit.

The suit says Herbert and Denault sent certified mails to the tour company. It included the unlawful practices of Vantage Travel and demanded relief. However, the plaintiffs achieved no success, as the company denied to provide them with any refund.

The suit seeks to represent any person who spent money to obtain a 15 day river cruise, known as “Majestic Rivers of Europe”, but received a cruise which consisted of five days, also an eight-day bus trip.

Thus, the lawsuit alleges Vantage Travel of violating the Massachusetts Consumer Protection Act, breach of contract, breach of the covenant of good faith and fair dealing. Furthermore, the allegations are over the unjust enrichment, as well as breach of common law warranties and negligent misinterpretation.

The plaintiffs of the proposed class action lawsuit are seeking the following: actual damages, injunctive relief and other relief deemed appropriate by the court, attorney’ fees disgorgement and restitution.
