WIX.com is currently under a class action lawsuit. The suit alleges the company of violating Telephone Consumer Protection Act (TCPA). In other words, plaintiffs accuse WIX.com of making unsolicited automated telemarketing text messages to cellular telephones. In addition to that, the company didn’t have prior express consent. This also includes people with telephone numbers registered on the national do-not-call lists.

The plaintiffs who filed the lawsuit against Wix.com state the company is using caller identification technology. Furthermore, they claim WIX.com takes this step for capturing any individual’s or entity’s cellular telephone number who is calling the company’s general business number. After this step, WIX is sending a text message to the captured cellular telephone number. It’s essential to mention the process of sending text messages occurs automatically without any person’s intervention. The text message contains the following information: the company’s logo and a link to the company’s website.
What the plaintiffs seek is up to $1,500 for any individual or entity who received the company’s unsolicited text messages from this number 1-800-600-0949 within the previous four years.

The Telephone Consumer Protection Act (TCPA), enacted in 1991, aims to protect any person from unwanted solicitation. It includes robocalls, invasive text messages, as well as auto dials and telemarketers. The TCPA has a National Do Not Call Registry.
